The Firm will act as the controller of your personal data within the scope of the relationship established with you.   1. Types of Personal Data and information processed

The Firm collects only the information necessary to provide its services or as otherwise set forth in this Privacy Policy, including:

  • Identification, qualification, and contact data: full name, date of birth, copies and details of identification documents (driver’s license, bar registration, passport, ID, CPF), email address, and phone number;
  • Academic and professional data: place of work, profession, position, and educational background.

If you are one of our clients, in the context of providing legal services, the Firm may access and process a broad range of your personal data, as well as data relating to other individuals involved in a given matter or project (for example, the opposing party in a legal proceeding or contract).

In addition to the examples above, we may process personal data such as: assets, receivables, transaction history, financial information, compensation, publicly issued certificates containing personal data, and loans.

Personal data may be collected by MJAB in various ways: directly from the Data Subject, from someone related to the Data Subject (such as the company where you work), or from publicly available sources. Regardless of the source, type of data, or individual to whom it relates, its processing will be governed strictly by this Privacy Policy.

  1. Purpose of processing personal data

As a general rule, we process personal data to provide client services and legal assistance, whether advisory or contentious, including, but not limited to:

  • Drafting, reviewing, or negotiating contracts;
  • Preparing documents required under Brazilian law;
  • Representing clients’ interests in judicial, administrative, arbitral proceedings, or investigations;
  • Conducting meetings, videoconferences, or conference calls to discuss various matters;
  • Representing clients before third parties, including government authorities;
  • Pro bono work;
  • Providing training;
  • Analyzing new products, cases, or situations presented by clients for the preparation of responses, memoranda, legal opinions, or advisory reports.

The Firm may also use your personal data to identify and provide relevant content in order to maintain its relationship with clients, employees, and visitors, including through the distribution of publications, institutional communications, newsletters, event materials, invitations, surveys, and feedback requests.

Finally, if you are an individual client or a representative of a corporate client, MJAB may process your personal data for purposes related to entering into agreements with the Firm, billing, invoicing, and compliance with reporting obligations to competent governmental authorities.

  1. Data sharing and international transfers

MJAB may share and transfer your personal data to service providers and partners located abroad. Whenever your personal data is transferred outside Brazil, we will adopt appropriate measures to ensure adequate protection in accordance with applicable data protection laws.

The Firm may share your personal data with third parties as follows:

  • For communications related to legal services, including with local counsel, experts, partner firms, auditors, accountants, financial institutions, specialists, and translators;
  • Government authorities;
  • National and international legal publications; and
  • Software providers and other IT service providers for purposes of managing records, documentation, and related activities.

MJAB is committed to keeping your personal data secure. To this end, the Firm implements security systems and technical, physical, and organizational measures, adopting best market practices to protect your personal data.

In the course of providing services or interacting with you, we may provide links to third-party websites. The Firm is not responsible for such websites or their content. We do not share, endorse, monitor, validate, or accept how these websites or content storage tools collect, process, or transfer your personal data. We recommend reviewing the respective privacy policies of such websites and organizations.

  1. Correction, updating, and deletion of Personal Data

MJAB will always provide you with the means to ensure that your personal data is accurate and up to date. As permitted by applicable law, you may request the correction, updating, or deletion of your personal data.

We will store and retain your personal data: (i) for the period required by law; (ii) until the processing is completed; (iii) for as long as necessary to protect MJAB’s legitimate interests, as applicable; and (iv) for as long as necessary to safeguard the Firm’s rights in judicial, administrative, or arbitral proceedings.

To make such requests, you should send an email to dpo@mjab.adv.br, and we will make reasonable efforts to comply with your request.

The processing of personal data will cease in the following cases:

  • When the purpose for which the data was collected has been achieved;
  • When the Data Subject exercises the right to request termination of processing and deletion of personal data; or
  • When required by law.

In such cases, subject to applicable legal requirements or this Privacy Policy, the personal data will be deleted.
